Terms of Service

These Terms of Service ("Terms") govern your access to and use of gopodcast.me ("we", "us", "our") and our products and services, including tools to convert text and documents into audio and to distribute that audio via embeds and RSS feeds (public or private).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

• The Service allows you to upload or provide content (including PDFs, text, and URLs) and generates corresponding audio files.
• We store your uploaded content (including extracted article text) and the generated audio to provide playback, download, embedding, and podcast feed functionality.
• Private RSS feeds are unique, non-guessable links. Anyone with the link can access the feed; treat it like a secret token.

2. Accounts and Eligibility

• You must be at least 13 years old to use the Service.
• You are responsible for safeguarding your account credentials and for all activities under your account.
• Provide accurate information and keep it up to date. We may suspend or terminate accounts for violations of these Terms.

3. Your Content

• You retain ownership of the content you upload or provide to the Service (including PDFs, text, URLs, and extracted text).
• You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and create derivative works (audio files) from your content solely to operate and improve the Service.
• You represent and warrant that you have all rights, licenses, and permissions necessary to provide your content and to grant the license above.

4. Public and Private Sharing

• If you choose to make content public (e.g., public embeds or a public podcast feed), you understand that associated audio and metadata may be accessible to anyone with the link and may be indexed by third parties.
• Private feeds are accessible to anyone with the private link. Do not share private links publicly. Contact support to request regeneration of a private feed URL if it is compromised.

5. Acceptable Use

• Do not upload content that infringes third-party intellectual property, privacy, or publicity rights, or that violates any law, regulation, or court order.
• Do not use the Service to generate or distribute illegal, harmful, deceptive, or hateful content; malware; spam; or to attempt to bypass usage limits.
• Respect word-count and rate limits. We may throttle or suspend accounts to protect the Service.

6. Subscriptions and Billing

• Paid plans are billed via third-party payment processors (e.g., Stripe). By subscribing, you authorize us and our processor to charge your payment method for recurring fees and applicable taxes.
• Plan limits (including word counts and features) are described at checkout and/or within the app. Exceeding limits may require upgrading your plan or result in throttling.
• Unless otherwise stated, subscriptions renew automatically until canceled. You may cancel at any time, effective at the end of the current billing period.
• Fees are generally non-refundable except where required by law or explicitly stated otherwise.

7. Third-Party Services

We rely on third-party providers for authentication, payments, hosting, storage, and text-to-speech processing. Your information may be processed by these providers solely to deliver the Service. See our Privacy Policy for details.

8. Intellectual Property

• We and our licensors own all rights, title, and interest in and to the Service, including software, design, and branding. These Terms do not grant you any right to use our trademarks or brand features.
• You may not reverse engineer, decompile, or attempt to extract source code of the Service, except to the extent such restrictions are prohibited by law.

9. DMCA and Copyright

If you believe that content on the Service infringes your copyright, please contact us with a detailed notice. We may remove or disable access to allegedly infringing material and terminate repeat infringers where appropriate.

11. Disclaimers

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• We do not guarantee uninterrupted or error-free operation, or that content will be preserved without loss.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

14. Suspension and Termination

• We may suspend or terminate your access to the Service at any time for conduct that we believe violates these Terms or harms other users or the Service.
• You may stop using the Service at any time. You can request account deletion from within the app or by contacting support.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to its conflict of law principles. The exclusive venue for resolving disputes shall be the courts located in that jurisdiction, unless applicable law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
